Penny was 24 years old at the time of the incident and had served in the Marines for four years. He was discharged from the Marines in June 2021.
In May 2023, he was on a subway train in New York City when he saw Neely, a 35-year-old Black man, dancing and singing on the platform. Penny approached Neely and put him in a chokehold. Neely struggled for several seconds before going limp. He was pronounced dead at the scene.
Penny was charged with manslaughter.

On Monday, Neely, who was homeless and seemingly having a mental health crisis, was reportedly yelling and acting erratically on a New York Subway, when Penny put him in a fatal chokehold on a Manhattan subway train. Part of the incident was captured on video by Juan Alberto Vazquez, an independent journalist. Vazquez told the New York Times that Neely had not assaulted anyone before he was put in a chokehold for approximately 15 minutes.
But he was choked to death. Mr Neely, remembered by some commuters for his Michael Jackson impersonations, had been dealing with homelessness and mental illness in recent years, friends said. Mr Neely had been arrested multiple times and had recently pleaded guilty for assaulting a 67-year-old woman leaving a subway station in 2021. Mr Neely was dishevelled and told people he was hungry and in need of spare change.
Mr Abrams said he approached Mr Neely and asked him why he no longer performs. The delay helped fuel protests in the city. Some people climbed down to subway tracks, disrupting service and leading to arrests.
An officer at the station got Neely to calm down and took pictures of the attacker and victim, Baltazar said. Castillo Baltazar, 68, claims he was assaulted by Jordan Neely in 2001. He declined an offer to go to the hospital because he wanted to make it to his job, he added. Neely was charged with assault for striking Baltazar. The case was adjudicated and sealed by the courts and the outcome was not immediately disclosed.
The Marine is expected to be charged with manslaughter in the brazen subway chokehold killing.
